The Council for the Assurance of the Quality of Higher Education is an independent body recognized in the Constitution of Ecuador, with a particular composition: three academic members appointed by the Executive and three appointed through a competition of merits and opposition. This article aims to analyze the implication of parity in the allocation of spaces in the Public Administration, through the study of the opposition and merits competition of the Council for the Assurance of the Quality of Higher Education for the period 2021-2026, in which alternation was prioritized over parity, resulting in a composition of four men and two women. To this end, legal methods of doctrinal and jurisprudential analysis were applied, which allowed for the examination of the administrative and judicial phases of the contest. Additionally, it was assessed whether there was a violation of rights and whether the final decision of the Electoral Contentious Tribunal, which addressed the challenge presented by a displaced participant despite having obtained the third best score, complies with the constitutional provisions underpinning the Ecuadorian political and constitutional system.
